I smashed my car up when some idiot flew thru a stop sign recently. My car was heavily damaged, and the other car is totaled. So I went to the police station today to get a copy of the police report, so I could contact the other guy's insurance company. The nice lady at the station gave me the report, but I could not find the other guys insurance company. She looked at it for me and said "he didn't have insurance, in fact the car was not even registered". I can't tell you how mad I was at that point. This a##hole was driving an unregistered car, no insurance, and went thru a stop sign to cause a significant accident, and he was sent home just like me ?? The report does say that he was cited for the 3 charges (no reg, no ins, and going thru a stop sign), but why don't violators like this get arrested? I'm not faulting the police. They were extremely professional, polite, and helpful at the accident.
If that's the policy, than so be it. But WHY? I've seen people get taken out in cuffs at Walmart for stealing a $10 shirt. This guy is gonna cost my insurance company about $6,000 and he gets a ticket and sent home !! You know who pays for this jerks accidents? YOU AND ME thru our ridiculously high insurance rates.
I'm the guy that makes sure my registration renewal gets mailed back the day I get it, the inspection sticker is up to date, and the insurance is all paid. For what ?? So that this jerk can laugh at us suckers that act responsibly? I'm sure he's been thru this before and he'll show up in court and cry about how he has no money and no work. He'll be told to come back in a year and we'll forget about it. He's probably driving another car around today without insurance. How will these people understand that this behavior is not acceptable if they never have to answer for it?

I think those of us who try and live a decent life can relate to your frustration. In all my years on the the internet I have never read something I wanted to respond to until now.I live my life very methodically and take pride in the fact that I am a responsible person. I can appreciate that feeling of disbelief when others seem to get away with crap I would never dream of. What I do know is that someone much bigger than them is keeping an open eye on the situation! So, bear that in mind and pass along good cheer...it will come back to you!

Ok....here's how bad this system is for honest people.

My insurance company paid $5k+ to fix my car. I paid $650 to rent a car for a month, plus my $500 deductible. So I filed a small claims case against the bum that hit me. Today I received this in the mail from the Trial Court of The Commonwealth of MA.

" Dear Sir,
The First Class notice in which we sent to the defendant in the above case has been returned to us by the Post Office because the address is not a good address. Therefore, judgment cannot enter. To proceed with this case you must notify us in writing of a new address for the defendant and request Officer Service. We will then set a new trial date and send the paperwork to you. You will have to hire a sheriff or constable to serve papers on the defendent"

Can you believe this? It's up to me to get a good address ! I went to the DMV with my accident report and the letter from the court in my hand. They could not tell me anything about the current address of the defendant "because of privacy laws". I called my insurance company and was told that they turned the case over to a collection agency, however they almost "never collect anything in Massachusetts because the State is so uncooperative".

It appears that the bottom line is that the scum that drive unregistered and uninsured vehicles have nothing to fear when they smash into another car, as long as it's in Massachusetts.:(

Sorry to hear about your difficulties Mota. If you are unable to get a valid address for him, after making reasonable attempts to serve him personally (as you appear to be doing), you may be able to provide him with notice/service by publication which means that you publish the Summons and Complaint in the newspaper that the defendant’s most likely to read. You have to ask the court’s permission to do this but it is an option if all else fails. Then if he doesn't show you would likely get a default judgment - the real hard part would be finding him to collect your judgment.
